The Management of Health and Safety at Work Regulations 1999 and The Social Security (Claims and Payments) Regulations 1987 explain that you have a responsibility to carry out accident investigations to establish the background behind the accident so that you can take the required measures to minimise the likelihood that similar incidents will happen again.

It is important to remember that, even if the need for the investigation has been brought about by a civil claim or as a result of an Improvement Notice or a Prohibition Notice, the objective is not to apportion blame but to find the root causes of the accident.

The ability to put things right also offers another direct benefit.  If you can minimise the likelihood of reoccurrence you will also minimise the likelihood that you will face more claims or even prosecution in the future.
